Trump wants IVF, fertility treatments available across America

The Alabama Supreme Court recently ruled that existing law does not just cover fetuses in the womb, but also embryos held in a lab or storage facility.

The said decision did not explicitly ban in vitro fertilization (IVF), but it left people in the dark about whether clinics and medical workers should still handle embryos. This brought fear to doctors that they could be sued for destroying embryos, which are often discarded during the IVF process. Reasons could be because of genetic abnormalities or if patients just decide to not use them.

On his social media platform, the Truth Social, former president and GOP front-runner in the 2024 presidential election Donald Trump posted: "Under my leadership, the Republican Party will always support the creation of strong, thriving, healthy American families. We want to make it easier for mothers and fathers to have babies, not harder! That includes supporting the availability of fertility treatments like IVF in every State in America." He vowed to make sure that IVF for couples who are trying to have a precious baby will always be available.

He directly addressed the Alabama state legislature as well, demanding it to find an immediate solution to preserve the availability of IVF in the state. "The Republican Party should always be on the side of the Miracle of Life and the side of Mothers, Fathers, and their Beautiful Babies. IVF is an important part of that, and our Great Republican Party will always be with you, in your quest, for the ULTIMATE JOY IN LIFE!" Trump wrote.

Alabama Attorney General Steve Marshall responded to concerns about IVF treatment after the state Supreme Court ruling. In an email to Newsweek last week, Marshall's chief counsel Katherine Robertson said: "Attorney General Marshall has no intention of using the recent Alabama Supreme Court decision as a basis for prosecuting IVF families or providers."

The news outlet reported that the premise builds on the overturning of Roe v. Wade in June 2022, when states enacted anti-abortion laws. While most Republicans argue these laws will save unborn fetuses, most Democrats see them as an attack on women's health care and their bodily autonomy.

Meanwhile, Representative Nancy Mace (R- SC) told Axios last week that she is working on a legislative response to the said Alabama decision on banning the embryos. "We should do everything we can to protect IVF for women everywhere," Mace said. "We are currently drafting a resolution to express our sentiment and then looking at legislative options."

In January, President Joe Biden and Vice President Kamala Harris made their first joint reelection campaign appearance at an abortion-rights rally in Virginia. "Give me a Democratic House of Representatives and give me a bigger, bigger Democratic Senate where we will pass a new law restoring and protecting Roe v. Wade, and I will sign it up immediately," Biden said.

Biden blames Trump on the Alabama IVF ruling

Following the release of the Alabama SCOTUS decision, Biden laid the blame on Trump because according to him, the ruling is a "direct result" of the Supreme Court overturning Roe v. Wade.

"Today, in 2024 in America, women are being turned away from emergency rooms and forced to travel hundreds of miles for health care, while doctors fear prosecution for providing an abortion," Biden said in a statement. "And now, a court in Alabama put access to some fertility treatments at risk for families who are desperately trying to get pregnant. The disregard for women’s ability to make these decisions for themselves and their families is outrageous and unacceptable." The president "promised" to keep fighting for women’s reproductive rights and to restore the protections of Roe v. Wade at the federal level.

In a separate statement, Biden's campaign tied the Alabama decision directly to Trump's appointment of three conservative justices to the Supreme Court during his first White House term. "What is happening in Alabama right now is only possible because Donald Trump's Supreme Court justices overturned Roe v. Wade," Biden's campaign team claimed.
