Nutritional supplement company allowed to make health claim, but with FDA disclaimer

After petitioning the FDA, the nutritional supplement company Nutrition 21, Inc. was granted permission to make the following claim for chromium picolinate: "One small study suggests that chromium picolinate may reduce the risk of insulin resistance, and therefore possibly may reduce the risk of type 2 diabetes. FDA concludes, however, that the existence of such a relationship between chromium picolinate and either insulin resistance or type 2 diabetes is highly uncertain."
Nutritional supplement maker Nutrition 21 Inc. said Monday that the Food and Drug Administration has allowed the company to make a health claim concerning chromium picolinate and the possible risk reduction of Type 2 diabetes.
Shares have fluctuated between 40 cents and $1.40 over the past 52 weeks, and are up 36 percent so far this year.
In a statement, the company said the agency allowed the following health claim for chromium picolinate: "One small study suggests that chromium picolinate may reduce the risk of insulin resistance, and therefore possibly may reduce the risk of type 2 diabetes.
FDA concludes, however, that the existence of such a relationship between chromium picolinate and either insulin resistance or type 2 diabetes is highly uncertain."
The response follows two 60-day delays in April and June issued by the FDA concerning the company's petition.
The FDA did not allow other health claims submitted by the company.
