The active consent form requires that children have parents check "yes" or "no" if the child's participation in the mental health screening is approved or disapproved; then the form must be signed and returned to the school. The passive form (waiver of consent) requires that parents return the form only if they do not want their child to participate in the screening. In other words, if the parent fails to return the passive form their child will be screened—something along the lines of "Hey, you didn't return the form so we assume you want your kid's mental health tested.

If your local mental health screening program is approved by the Board of Education as part of the educational program, you are not required to get active parental consent under PPRA. Passive consent is sufficient in this circumstance. It is best to recommend that, if passive consent is obtained from parents, then active consent should be sought from participants as a safeguard. Active parental consent must be obtained, however, if a child is going to be removed from an instructional activity for screening.
