And since any real progress in health care legislation is nothing but a pipe dream (there are way too many jobs and investors tied up in the continued diseasification of the American people to expect any real reforms), I thought I'd offer my own version of that pipe dream for your general amusement. |

I'm curious to know whether Glenn Ivey will support this new legislation in the U.S. Senate that would clearly classify his own actions as acts of terrorism...

| At the bottom, there are all the laws that apply to the people, which include this anti-terrorism legislation. But at the top, none of those laws apply to the people running the State. Maryland's Attorney General will never be charged as a terrorist, even if his actions clearly qualify him as one under U.S. law. President Bush will unfortunately never be charged as a murderer, even though his war actions clearly qualify him as a mass murderer (if you kill just one person, it's called murder, but if you kill a hundred thousand, it's called war). |
| There is absolutely no question that under the new legislation that's about to pass the Senate, called the Violent Radicalization and Homegrown Terrorism Prevention Act, Glenn Ivey's actions would qualify as acts of terrorism. (See our previous report on this topic at http://www.newstarget.com/022308.html ) Even more interestingly, Glenn Ivey merely thinking about threatening parents who don't get their children vaccinated would, all by itself, be considered a terrorist "thoughtcrime" act.

It is a sick situation that this new fake safety legislation provides the FDA with unprecedented new power to stamp out competition to drug companies as well as expose Americans to far greater safety risks than ever before. Provisions within the legislation that creates the Reagan-Udall Foundation for the FDA will allow the FDA to remove any dietary supplement from the market based on its whim.

Big Pharma will whine that this legislation is too tough on them, which is a fallacy. This legislation is the Big Pharma dream come true. In a football analogy the only question is the final score. There must be no confusing the safety of drugs and the safety of food and food ingredients - which are governed by different laws. This bill authorizes, on pages 106-107, the creation of a new regulatory category that enables the FDA and the Reagan-Udall Foundation for the FDA to attack dietary supplements and functional foods. This problem in the wording can be corrected with this simple amendment - so as to be sure this legislation is about drugs and drug safety only. |

Attempts by well meaning senators to correct flagrant flaws in the legislation were either watered down to the point of nonsense or blocked entirely.
Many key issues were not addressed, such as the FDA's legal position to prevent citizens from suing drug companies, the massive (and oftentimes illegal) off label promotion of drugs by the legion of Big Pharma sales reps, medical journals that are full of fraudulent Big Pharma promo pieces that misrepresent the safety and efficacy of drugs currently on the market, and a large percentage of doctors on the take from Big Pharma. |

I've offered many suggestions in a popular article, The health care reform legislation that Congress should pass, but won't. Lawmakers, you see, have no interest in actually saving America from financial demise. They're only concerned about the next election, and raising campaign reelection funds means kow-towing to the interests of the powerful corporations that really run Washington.
Personally, I don't see that meaningful reform is possible under the current system of politics in America. |

My office has been inundated by calls from people throughout the country who believe that this legislation, specifically the provision establishing a Reagan-Udall Institute, will overturn the Dietary Supplement Health and Education Act of 1994. That has not been my reading of the bill, but I wonder if other Senators have heard similar concerns?

| While Enzi refused to change the language, we created such an uproar that assurances are officially in the Congressional Record that this legislation is not to be used to harass dietary supplements.
And we headed off a potential attack by Durbin -- who for some reason is always trying to get vitamins classified as drugs (more safety hypocrisy). What was really being debated was the extent to which the Big Pharma monopoly would be allowed to continue, an issue that was too politically incorrect to describe publicly. | Their legislation perpetuated the user fees allowing Big Pharma to buy mob-like protection from the FDA. The bill created the Reagan-Udall Foundation for the FDA to hold FDA-related patents and allowed the FDA to license technology to drug companies -- thus turning the FDA into a drug company with vested interests in specific medicines. None of these blatant conflicts of interest, which are also primary safety issues, seemed to bother any senators at all. |

Also, Sherrod Brown discussed his amendment to prevent Big Pharma from gaming a citizen's petition system that Big Pharma uses to delay generic drug competition (some aspect of this may make it into the legislation). Durbin offered an amendment for meaningful changes to FDA advisory panels. This is a really good amendment and is unlikely to go anywhere.
Thus, Kennedy and Enzi are stonewalling all meaningful change to protect Big Pharma. This bill looks like it's going to pass. |

Enzi has refused to place the Emord amendment into the legislation, insisting that dietary supplements are not threatened by the language (which is false).
Following the Senate vote, the battle will move to the house and then to a conference committee.
Hatch and Kennedy are already on record saying they will seek to add a biologic drug pathway for approval as an amendment in the conference committee. This will dovetail with the Reagan Udall Foundation and will lock in the Big Pharma-Big Biotech monopoly for the next 50 years. |

That, of course, requires money, and corporations have lots of that -- especially when they run FDA-enforced monopoly price fixing schemes that clearly qualify as crimes under existing anti-trust legislation.
