Red Yeast Rice One of the first major policosanol products distributed in the United States was Cholestin, made by a company called pharmanex. But before it contained policosanol, Cholestin contained red yeast rice. It's a tale of woe and intrigue—a story of Big Pharma and the FDA ganging up on a small herbal company. Pharmanex discovered that Chinese researchers had found that red yeast rice could lower cholesterol and triglycerides. Also in 1999 a Utah court interpreted DSHEA to mean unambiguously that dietary supplements are to be regulated as foods, not drugs, and that they can be sold even when they contain active ingredients identical to those in prescription drugs. In pharmanex v. Shalala, the court ruled that the FDA had no right to restrict sales of Cholestin, a "milled red yeast rice" supplement, even though it contained a chemical indistinguishable from lovastatin, the active ingredient in cholesterol-lowering prescription drugs.
As noted in the previous chapter, the courts overruled this action in pharmanex v. Shalala and allowed Cholestin to be sold as a dietary supplement (although a federal court later overturned this decision). Researchers have confirmed that Cholestin reduces blood cholesterol levels by about 10%, but they note that it is formulated to contain higher levels of active ingredients than traditional red yeast rice. As a prescription drug, lovastatin has been studied extensively, but hardly any research has been done on the eight other cholesterol-lowering ingredients in Cholestin.
