Cipro and its high blood-pressure drug Adalat, and nearly $252 million in civil penalties under the False Claims Act.' Bayer's conduct was billed as "the largest Medicaid fraud in history."10 The whistleblower in this case, Mr. Couto, died of pancreatic cancer before bayer pled guilty. But this wasn't the first time bayer had made fraudulent claims to the Medicaid program. Back in 2001, bayer agreed to such a corporate integrity agreement, and agreed to pay $14 million for underpaying the Medicaid program. |
| Bayer Pleads Guilty
In 2003 bayer, a German company, pled guilty to violating the federal Prescription Drug Marketing Act, signed a corporate integrity agreement, and paid $257 million. This included a criminal fine of $5.6 million for overcharges involving its antibiotic Cipro and its high blood-pressure drug Adalat, and nearly $252 million in civil penalties under the False Claims Act.' Bayer's conduct was billed as "the largest Medicaid fraud in history."10 The whistleblower in this case, Mr. Couto, died of pancreatic cancer before bayer pled guilty. |

When Weir and I wrote Circle of Poison twenty-five years ago, bayer was one of the companies we identified as selling organochlorine pesticides like aldrin and dieldrin to Mexico and other developing countries, which it couldn't sell in the United
States. Now many of those same chemicals are on the POPS list. In 2005, bayer voluntarily withdrew lindane from the Mexican market in advance of that country's national ban taking effect. |

Heroin was launched as a medicine by Felix Hoffman, an employee of bayer, only a few days after he invented aspirin. bayer immediately applied for a trademark on the term "heroin," then began marketing the drug as a cure for morphine addiction. It was also marketed as cough syrup for children.

In 2005, bayer voluntarily withdrew lindane from the Mexican market in advance of that country's national ban taking effect. bayer could not sell lindane on its home turf but it had no problem doing so in the United States: according to a "Lindane Risk Assessment Fact Sheet" issued by the EPA, the amount of lindane applied annually as a seed treatment in the United States was between 65 and 105 tons yearly as of early 2006.' |

And thete have been problems. Bayer's Baycol was removed from the market in 2001 after reports that 31 people taking it had died from a rhamdomyolysis, a rare disorder involving muscle-tissue breakdown that leads to kidney failure. According to a 2004 article in JAMA, bayer learned as early as 1999 that serious adverse reactions were associated with their drug. "To our knowledge," claim the JAMA authors, "these findings were not disseminated or published. |

I've become pretty cynical due to my own experiences, but even I was shocked by what happened at Merck. In 2004, Merck's withdrawal of Vioxx resulted in a 27 percent drop in stock value and exposed the company to billions of dollars in liabilities. |

It is no coincidence that the parent company of bayer, the manufacturer of numerous vaccines and children's medicines, was deeply involved in the medical experiments conducted in Nazi Germany. I've detailed this in my book Natural Health Solutions and the Conspiracy to Keep You From Knowing About Them.

He said that the largest HMO in the US, Kaiser Permanente, allegedly threatened to stop buying Bayer's antibiotic Cipro because Johnson & Johnson's Floxacin was being offered at a much lower price.
The New York Times noted that, because Kaiser was buying $7 million of Cipro a year, bayer wanted to reduce its price without having to give additional rebates to the state-funded Medicaid program. Under US law, companies are obliged to offer Medicaid the lowest prices, so both companies had reason to concoct a plan that obscured them, thereby defrauding the US taxpayer. |

While the public, historically, has been innocently unaware of these details, they are starting to get wise. In the public's view, the pharmaceutical industry has recently joined the oil industry as the most exploitative and reviled sector of corporate America. The perception of manipulation and arrogance on the part of Big Pharma is starting to stick. A trust factor appears to have been violated. |

Pollen-sterilizing barnase in GM crops may cause kidney damage
As part of the process of breeding hybrid corn, Aventis (now bayer CropScience) developed male-sterile corn (MS6) that is incapable of producing viable pollen—it will not out-cross or self-pollinate.* This was accomplished by inserting a gene from a bacterium that creates the enzyme barnase.
Bamase is a known toxin. It degrades single-stranded RNA, is toxic to a variety of human cell lines,64 and can destroy plant cells in which it is expressed.65 When injected into rats, it causes kidney damage. |
| Liberty Link crops can tolerate Bayer's Liberty herbicide (active ingredient glufosinate ammonium). They are both broad spectrum herbicides—designed to kill all other plant life. When farmers buy HT seeds, they are also required to buy the company's corresponding herbicide.
The glyphosate in Monsanto's Roundup kills plants by inhibiting an enzyme (EPSPS) that is needed for producing key amino acids. Some scientists discovered bacteria in a chemical waste pond near the Roundup factory that survived in spite of the presence of the herbicide. |
| Chardon LL corn by bayer, for example, contains most parts of a bacteria-derived ampicillin resistance gene, a modified bacterial sequence that is 70% homologous to the original, and most of a plasmid made from E. coli.
3. Self-replicating bacteria: The plasmids used to multiply transgenes contain a piece of DNA called an "origin of replication." This sequence causes the plasmid to replicate itself over and over again. Since the whole plasmid was often inserted with the transgene, many GM crops (e.g. GM papaya and potatoes) contain this origin of replication sequence. |
| They were in response to bayer CropScience's 2003 petition to approve maximum threshold levels of glufos-inate ammonium on rice, anticipating the marketing of their Liberty Link variety.
"We find EPA's statements on the potential of glufos-inate to function as an endocrine-disrupting substance in humans and animals as not founded on logical information or peer-reviewed studies. In fact EPA states that no special studies have been conducted to investigate the potential of glufosinate ammonium to induce estrogenic or other endocrine effects.... |

Like IG Farben was for the German pharmaceutical companies of Nazi Germany, the American Chemistry Council acts much like a front group for chemical industry bigwigs like bayer (which was incidentally also a member of IG Farben), BP, Chevron, Dow, DuPont, Exxon, Honeywell, 3M, Monsanto and Procter & Gamble. Studies have already proven that the chemicals made by these companies have long-term effects on children and adults. |

Reports of sometimes fatal muscle-wasting linked to Bayer's statin Baycol, when taken in conjunction with a second drug, led to a voluntary withdrawal from the market several years ago, and the company and its insurers have had to put aside more than a billion dollars to fight or settle thousands of the resulting lawsuits.56 The company's view is that it marketed the statin responsibly, and it is fighting each suit on a case-by-case basis. Without admitting any wrongdoing bayer has so far settled 3000 cases, and has another 8000 pending. |

Ethyl itself was a truly global firm, and had independently joined forces with Hitler's staunchest corporate supporters, forming the firm Ethyl Gemeinschaft in 1934. Regarding the value of Ethyl's work for the Nazis, a report from I.G. Farben credits the firm and its major partner, Standard Oil, with directly fueling the German war machine. Standard Oil gave Germany one thing it did not have—a way to boost the power of its gasoline—through the production of ethyl gasoline. |
